LOCK HAVEN - A Clinton County jury found former Lock Haven University Student, Devon Jarrett Bushor, 22, guilty Monday night of Felony 2 Sexual Assault and Misdemeanor Indecent Assault following a 2-day trial. The jury deliberated for approximately 4 hours into the evening Monday, before returning a verdict just before 9 pm. The conviction is the second sex offense Bushor, a Hughesville High School graduate, has been convicted of committing against a female college student in the past 14 months. In January of 2022, Bushor was convicted of Indecent Assault by forcible compulsion against a female LHU student. In that case, Bushor pled no contest to pinning a young woman's arms to her sides and forcibly having sexual intercourse with the victim.
Due to rules of evidence, the jury wasn't able to hear about Bushor's other sexual assault case. Over the course of the 2-day trial, the jury saw 10 witnesses testify about a November 2019 party at the fraternity house of the LHU Chapter of Alpha Chi Rho, or "CROW" as witnesses referred to it. The victim, an 18-year-old girl who was not a student at LHU, was in town visiting a friend who attended the University. The victim attended a fraternity party with her friend and several other students. While at the party, the victim was observed by several witnesses as being visibly intoxicated. The victim vomited outside the party, and fell down a full flight of stairs inside the CROW fraternity house before she was escorted by the then-fraternity president, and another fraternity brother, Devon Bushor, to an isolated part of the house. While in that room, witnesses testified that the victim was repeatedly given water to drink by the fraternity brothers, who were concerned about her safety and her level of intoxication. The victim remained in that isolated portion of the fraternity house for some time, and Bushor remained with her to, as witnesses said, to "keep an eye on her".
A short time later, witnesses said they came back to that room to find the victim nude from the waist down, and Devon Bushor standing near her. Witnesses described seeing bloody scratches across the victim's abdomen and hip, like those that would have been made by fingernails. Witnesses also explained that Bushor would later admit to having at least attempted to have sexual intercourse with the victim that night, despite her apparent intoxication and her having recently fallen down a flight of stairs.
The victim testified at trial that she was extremely drunk that night, and her memory was fragmented. She had never met Bushor before that night, and didn't know his name. The victim could only recall bits and pieces of the night, but remembered seeing Bushor sexually assault her. She remembered her arms being pinned down to her sides, and remembered not being able to move. The victim repeatedly told the jury she never consented, and never would have, to anything like that, especially with a total stranger. The victim also showed and described injuries she had suffered that night, from falling down a flight of stairs and from the sexual assault.
Clinton County District Attorney Dave Strouse prosecuted the case against Bushor, whose trial commenced Friday, March 24th. Bushor was represented by Attorney Michael Morrone.
Morrone argued throughout the trial that there was insufficient evidence to show that the victim was, in fact, intoxicated. He claimed the young woman was the sexual aggressor. He called the victim's testimony and her report to police a sign of her regret and embarrassment over having put herself in that position and engaged in sex with a stranger. He claimed the sexual encounter was consensual, and implored the jury that they should acquit his client of all charges.
DA Strouse told the jury that any young woman who is too drunk to walk is too drunk to have sex with, and the evidence had shown the victim had fallen down a full flight of stairs just prior to Bushor's sexual assault on her. He called Bushor as sexual predator, and described him as not just guilty in the eyes of the law, but morally guilty as well.
Along with the two guilty verdicts, the jury returned verdicts of not guilty on charges of Rape by forcible compulsion and Aggravated Indecent Assault, as well as one count of Indecent Assault by forcible compulsion. After returning the verdict, DA Strouse requested that Bushor's bail be immediately revoked, describing him as a repeat sex offender. Presiding Judge Michael F. Salisbury agreed, and scheduled sentencing at a later date. Salisbury also ordered that Bushor must be evaluated by the Sex Offender Assessment Board to determine if he should be classified as a Sexually Violent Predator (SVP) for Megan's Law Purposes. Bushor is already a registered sex offender for 25 years after his first conviction.
Bushor faces a maximum sentence of up to 12 years in a State Correctional Institution as a result of the convictions.
